1. Who you're contracting with

These Terms & Conditions form an agreement between you and The Ultimate Travel Guide ("we", "us", "our"), the seller and publisher of the Ultimate Barcelona Art & Architecture Guide (the "Guide") available at this website (the "Service").

2. Acceptance

By accessing the Service, creating an account, or purchasing the Guide, you agree to these Terms. If you do not agree, do not use the Service.

3. The product

The Guide is a digital PDF travel guide to Barcelona. Once purchased, it is made available for reading and download from your account.

4. Acceptable use

You must not misuse the Service. In particular, you must not: (a) use it for any unlawful purpose; (b) commit fraud or send spam; (c) infringe our or anyone else's intellectual property; or (d) interfere with the security or integrity of the Service, including by introducing malware, probing for vulnerabilities, or scraping content at scale.

5. Intellectual property

We retain all rights, title and interest in the Service and the Guide, including text, photography, design and branding. We grant you a limited, non-exclusive, non-transferable licence to download and use the Guide for personal, non-commercial use. You may not resell, redistribute, sublicense or republish it.

6. Service level

We do our best to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

7. Payments

The Ultimate Travel Guide is the seller of the Guide. Payments are processed on our behalf by Stripe, our payment processor. By completing checkout you also agree to Stripe's terms applicable to the payment method you choose. We do not store or have access to your full card details.

9. Suspension and termination

We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay, pose a security or fraud risk, or repeatedly or seriously violate our policies.

10. Liability

To the extent permitted by law, our aggregate liability for any claim relating to the Service is capped at the fees you paid us in the 12 months before the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the jurisdiction in which The Ultimate Travel Guide is established, without regard to its conflict-of-law rules. The courts of that jurisdiction will have exclusive jurisdiction over any dispute.
